Terms of Use
This Terms of Use Agreement (this “Agreement”), states the terms and conditions under which you may use this website (the “Site”). This Site contains various information relating to the Society for American Baseball Research (“SABR”) in the form of information, text, graphics, news, reports, videos, audio, music, and other materials (tangible or intangible) (“Content”). By accessing, browsing and/or using this Site you acknowledge that you have read, understood and agree to be legally bound by this Agreement. If you do not accept this Agreement (and therefore do not agree to be bound by this Agreement), do not use this Site. SABR reserves the right to amend this Agreement at any time by posting the amended terms on our Site.
Restrictions on Use of Materials
All Content is owned by SABR or third-parties and is protected by applicable copyright, trademark, and/or other intellectual property laws. Nothing contained on the Site should be construed as granting any license or right to use any of the Content without our written permission. Subject to your continued compliance with these Terms, SABR hereby grants you a personal, non-exclusive, revocable, non-transferable, and non-sublicensable license to access and use the Site and Content for your personal use. Any use of the Content (including our names, logos, and trademarks) will inure to our benefit.
You acknowledge that this Site contains Content that is protected by copyrights, trademarks, service marks, trade secrets, patents, or other proprietary rights, and that these rights are valid and protected in all forms, media, and technologies existing now and hereinafter developed. You also acknowledge that the Content is and shall remain the property of SABR or any other party (each a “Contributor”) who has been involved in the preparation or publication of the Content. You shall at no time assert any claims of ownership over any content by reason of your use of or any right to use this Site and shall not grant or create or suffer to exist any lien or other security interest arising therefrom. You agree to comply with all copyright and trademark laws and you shall not encumber any interest in, or assert any rights to, the Content. You may not modify, transmit, participate in the sale or transfer of, or create derivative works based on any Content, in whole or in part. You may print copies of the Content, provided that these copies are made only for personal, non-commercial use and that you maintain any notices contained in the Content, or maintained by the Contributor, such as all copyright, trademark, or other proprietary rights notices. You shall not store electronically any significant portion of any Content. SABR authorizes you to view and use the Content on this Site solely for your personal, noncommercial use. The use of the Content on any other site, including by linking, framing, or scraping, or in any networked computer environment for any purpose is prohibited without SABR’s prior written approval.
You represent, warrant, and agree that you will not: (i) remove any trademark or copyright notices contained in the Site or Content; (ii) reproduce, modify, publish, distribute, transmit, disseminate, transfer, license, sell, lease, create derivative works based upon, or in any way commercially exploit the Site or Content; (iii) use manual or automated means to trawl, mine, scrape, frame, or mirror the Site or Content; (iv) disassemble, decompile or reverse engineer the Site or Content; (v) attempt to hack, defeat, or overcome any encryption technology or security measures regarding the Site or our other systems or those of any third party, or gain any unauthorized access to any systems or accounts; (vi) interfere with or disrupt the operation of the Site or any other systems or otherwise interrupt or interfere with any other user’s use or enjoyment of the Site; (vii) violate any applicable local, state, national or international law; (viii) post or transmit any Content that is unlawful, defamatory, abusive, harassing, threatening, obscene, fraudulent or otherwise inappropriate or infringes any intellectual property or privacy rights of any person; (ix) send unsolicited advertisements through the Site; (x) use the Site in a way that will adversely affect us or reflect negatively on us, any of our goodwill, name or reputation; or (xi) provide any false or misleading information or any information that you do not have the right to provide.
For permission to use content from this website or from a newsletter authored and distributed by SABR, you agree to request written permission and provide full attribution. Permission should be requested by contacting https://sabr.org/about/contact-sabr/. Attribution for website content should be given as follows: “Reprinted with permission from the Society for American Baseball Research.”
Infringement
If you believe that any Content infringes your copyrights or that your intellectual property rights have been otherwise harmed, immediately notify our designated copyright agent by emailing jpomrenke@sabr.org. Your notice must comply with the requirements of the DMCA by including the following: (i) a physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed; (ii) identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site; (iii) identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material; (iv) information reasonably sufficient to permit us to contact you, such as an address, telephone number, and, if available, an electronic mail address at which the complaining party may be contacted; (v) a statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and (vi) a statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed. Our goal is to follow DMCA safe harbor provisions with regard to infringement claims. In addition to those outlined above, SABR will follow notice and take down provisions when SABR is notified that the Content is allegedly infringing material.
If you repeatedly infringe third party copyrights (e.g., by submitting Content without permission), whether proven or alleged, it is our policy to terminate your membership on the Site.
Disclaimer of Warranty
The content provided on this website is provided as a service to members of the public and members of SABR. Information presented on this website is provided for informational purposes only.
You acknowledge and agree that this site and the content therein are provided on an “as is” and “as available” basis. None of SABR, any of its members, affiliates or their respective officers, directors, employees, agents, or licensors (“SABR Parties”) guarantees the accuracy, completeness, or usefulness of any of the content.
Limitation Of Liability
The SABR Parties shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of or related to your use or inability to use the Site, Content, or any of its services. It is your responsibility to evaluate the accuracy, completeness, or usefulness of any information or any content available through the website.
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED $100 OR THE AMOUNT YOU PAID US IN THE PAST TWELVE MONTHS, WHICHEVER IS GREATER.
Because some jurisdictions do not allow the exclusion or limitation of liability for negligence, consequential or incidental damages, in such jurisdictions the SABR Parties’ liability is limited to the greatest extent permitted by law.
User Must Comply with Applicable Laws
This Site is based in Arizona in the United States. SABR makes no claims concerning whether the Content may be downloaded or are appropriate for use outside of the United States. If you access this Site from outside of the United States, you are solely responsible for ensuring compliance with the laws of your specific jurisdiction.
Miscellaneous
In the event that any portion of the Agreement is held to be invalid or unenforceable, the invalid or unenforceable portion shall be construed in accordance with the applicable law as nearly as possible to reflect the original intentions of the parties, and the remainder of the Agreement shall remain in full force and effect. The paragraph headings herein are provided only for reference and shall have no effect on the construction or interpretation of the Agreement. SABR’s failure to enforce your strict performance of any provision of this Agreement will not constitute a waiver of its right to subsequently enforce such provision or any other provision of this Agreement. Neither the course of conduct between parties nor trade practice shall act to modify any provision of the Agreement. The Agreement shall be governed by and construed in accordance with the laws of the State of Arizona except with regard to its conflicts of law rules. Any action relating to the Content, Site or this Agreement must be brought in the federal or state courts located in Arizona and you hereby irrevocably consent to the jurisdiction of such courts. Any cause of action you may have with respect to the Content, Site or this Agreement must be commenced within one (1) year after the claim or cause of action arose, or be barred. This Agreement contains the entire agreement of the parties for this Site and supersedes all existing agreements and all other oral, written or other communication between the parties concerning its subject matter. You agree to use the Content and Site only for lawful purposes. You are prohibited from any use of the Content or Site that would constitute an illegal offense, give rise to liability or otherwise violate any applicable local, state, national or international law or regulation.
SABR does not sell, lease, disclose, or otherwise make available personal information to third parties for monetary or other valuable consideration. Personal information is not shared for cross-context behavioral advertising or any similar purpose. Any disclosure of personal information is limited to service providers, legal or regulatory authorities, or other parties as strictly necessary to provide the services, comply with applicable law, or protect the rights, property, or safety of SABR or others, and in all cases subject to appropriate confidentiality and security obligations.
Third Parties
The Site may contain links to websites owned or operated by third parties. SABR does not control or endorse such websites and SABR is not responsible for their content, nor is SABR responsible for the accuracy or reliability of any information, data, opinions, advice, or statements contained within such websites. SABR has the right, but not the obligation, to review any Content provided by third parties (including other users of the Site). SABR does not endorse such third-party Content, and any views expressed therein are the views of the applicable author and do not necessarily align with our views. SABR is not responsible for the accuracy or reliability of any Content provided by third parties and will not be liable for any causes of action (including slander, libel, or invasion of privacy) relating to such third-party Content. SABR has no control over, and are not responsible for, your interactions (online or in person) with any third parties, including other users of the Site or any givers or nonprofits even if introduced via the Site. You are solely responsible for your interactions with any third parties. If you have any disputes with other users of the Site (whether givers or nonprofits), SABR may (at our discretion) attempt to facilitate a resolution but are under no obligation to do so.

Your use of the Site is subject to our Privacy Policy, available at sabr.org/privacy-policy, which is incorporated by reference.
No Refunds
All membership fees are final and non-refundable. Users are responsible for all charges incurred for the applicable membership period, regardless of usage, cancellation, or termination. No refunds, credits, or prorated adjustments will be provided for any reason, including dissatisfaction with the service, failure to use the membership, or early termination.
Release and Indemnity
You will release, defend, indemnify, and hold us, our past, present, and future affiliates, licensors, licensees, marketing partners, and suppliers, together with their respective officers, directors, employees, and agents, harmless from and against any damages, losses, claims, actions or demands, liabilities and settlements including without limitation, reasonable legal and accounting fees, resulting from your use of the Site, Your Content (including any content you post on your social media feeds), any donations received by you, or your violation of these Terms. SABR may opt to defend such claims at our sole discretion, in which case you will indemnify us for the costs of such defense.
Termination
SABR reserves the right, in its sole discretion, to restrict, suspend, or terminate this Agreement and your access to all or any part of our Site or the Content, at any time and for any reason without prior notice or liability. SABR reserves the right to change, suspend, or discontinue all or any part of this Site or the content at any time without prior notice or liability. Termination will not relieve either party from any obligations incurred or arising prior to such termination, and those sections of these Terms which are by their nature intended to survive termination (including, without limitation, the disclaimers, limitation of liability, indemnity, and general clauses) shall so survive.
